Terms of Business

This page sets out the terms of business between Century Business Finance Ltd and its clients. We are regulated by the Financial Conduct Authority (FCA) in respect of our broking activity in relation to certain loan agreements. We follow their guidance in terms of procedures, treating customers fairly and complaints in all instances.

Type of Business

Century Business Finance Ltd is a credit brokerage, not a lender. We arrange Unsecured Business Loans, Secured Business Loans, Merchant Cash Advances, Lease Hire & Hire Purchase via third parties. 

For agreements we arrange through third parties:

In addition to the commission we receive from any third-party funder, which ranges from 1%-15% of the loan amount, you shall pay a fee to us for the provision of our services to you. This fee will be taken from your bank account via direct debit within 7 days of you receiving the loan funds. You sign below to give your full authority for this payment to be taken and will not contest, indemnify or debit this payment back. If, for any reason, we do not receive the fee by direct debit, we will ask you to pay the fee by another method.

This fee is a financial services intermediary fee and is a separate payment from your loan agreement and is not a payment toward the balance of your loan agreement. This payment is payable to us, and not the lender, in addition to any loan interest or payments due on your loan agreement.

Insurance

We do not advise or arrange insurance products.

Advice and Recommendations

We do not offer financial advice. You are advised to consult your own financial advisor or accountant before entering into any agreement through us.

Your Duty of Disclosure

It is your responsibility to provide complete and accurate information to Century Business Finance Ltd when you apply for a loan or asset finance. It is important that all statements made on the proposal form, or on any additional documentation are full and accurate. Please be aware that if you fail to disclose any relevant information, or any change of circumstances to us any credit approval may be immediately withdrawn. We strongly recommend that the information you provide is checked thoroughly prior to submission.

Acting in your Best Interests

If any material interest or conflict of interest should arise in business that we are arranging for you, we will let you know and ask for your consent before we carry out your instructions.

Treating Customers Fairly

Treating customers fairly is at the heart of everything we do. We will act in your best interests at all times, provide excellent value products and services, ensure our communications are clear, concise and jargon free and if you have a complaint we will treat it seriously and resolve it quickly and fairly. Loan Purpose & Proof of Loan

If the loan purpose is for an asset, equipment or machinery purchase you authorise Century Business Finance Ltd to source a quote on your behalf and present to any prospective lender or lenders. You confirm that Century Business Finance Ltd, its employees and/or directors have made you aware of the quote contents and cost and that you agree to this content in order to satisfy the conditions of acceptance set out by the lender or lenders. You acknowledge that Century Business Finance Limited, its employees or directors hold no responsibility to ensure the loan is used for the above purpose stated or are liable for any loss incurred by you the borrower or the owners of the borrower which arise from any arrears, default, liquidation or administration of your company.

Financial Crime

All transactions relating to the services provided by us are covered by Money Laundering Regulations and the Proceeds of Crime Act. The FCA also requires that we have appropriate measures in place to prevent fraud, money laundering and other financial crime. Our responsibilities under these Regulations, and the rules of the FCA, include but are not limited to verifying the identity and address of our clients and of any third-party making payments on their behalf. Where we require, you must supply proof of your identity in accordance with the requirements of the above Regulations.

Financial Searches

Electronic searches of the electoral roll and the use of credit reference agencies, will result in a ‘foot-print’ on your credit records. This footprint is visible to other financial service providers and may affect your credit rating. We will only action searches if you agree to proceed with a credit approval process with us. Acceptance of our Terms of Business and a wish to obtain credit approval represents your permission to us to action a search and approach credit reference agencies regarding your financial affairs.
